1. Agreement to Terms
By visiting the Parker Visual LLC website, submitting an inquiry, or using any part of this website, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use this website.
These Terms and Conditions govern use of this website. Photography sessions and all related services, including portrait photography, professional headshot sessions, graduation portrait sessions, corporate sessions, corporate event photography, in-home portrait sessions, and print and card orders, are governed by the Parker Visual LLC Client Services Agreement, as described in Section 2.
2. Client Services Agreement Prevails
All photography services provided by Parker Visual LLC are governed exclusively by the Parker Visual LLC Client Services Agreement, together with any estimate, invoice, or booking confirmation incorporated into it under Section 56 of the Parker Visual LLC Client Services Agreement.
By booking, you agree to the Parker Visual Client Services Agreement. A copy for your signature will be sent once your booking is confirmed.
If anything on this website, including these Terms and Conditions, the Privacy Policy, any other policy page, service descriptions, or pricing, differs from or conflicts with the Parker Visual LLC Client Services Agreement, the Parker Visual LLC Client Services Agreement controls. As set out in Section 56 of the Parker Visual LLC Client Services Agreement, your estimate, invoice, or booking confirmation controls as to the description of services, the total fee, and payment due dates, and the Parker Visual LLC Client Services Agreement controls as to all other terms.
Information on this website about sessions, pricing, and policies is provided for convenience only and does not modify the Parker Visual LLC Client Services Agreement.
3. Booking, Payment, Cancellation, and Rescheduling
Retainers, balances, accepted payment methods, late payments, chargebacks, travel fees, location changes, cancellations, rescheduling, weather, and the right to discontinue a session are governed by the Parker Visual LLC Client Services Agreement. See Payment (Sections 6 through 12) and Cancellation and Rescheduling (Sections 13 through 20).
4. Deliverables, Copyright, Licensing, and Model Release
Edited images, delivery timelines, gallery availability, file retention, editing adjustments, print orders, raw files, AI-assisted editing, copyright ownership, image licensing, commercial use, model release, and privacy requests regarding portfolio use are governed by the Parker Visual LLC Client Services Agreement. See Sections 21 through 41.
Limitation of liability, assumption of risk, indemnification, client responsibilities, and dispute resolution for photography services are likewise governed by the Parker Visual LLC Client Services Agreement. See Sections 42 through 57.
5. Website Use
Visitors to the Parker Visual LLC website may use it for personal, informational purposes only. By accessing this website, you agree not to use automated tools or scripts to scrape or extract content, attempt to access restricted areas or systems, transmit malware or disruptive code, use the website in any way that violates applicable law, or reproduce or redistribute any content from the website without prior written permission from Parker Visual LLC. Parker Visual LLC reserves the right to restrict or terminate access for any visitor who violates these terms.
6. Intellectual Property
All content on the Parker Visual LLC website — including photographs, portfolio images, text, page design, graphics, logos, and the Parker Visual LLC name and mark — is the exclusive intellectual property of Parker Visual LLC and is protected under United States copyright and trademark law. No content from this website may be copied, reproduced, downloaded, distributed, modified, or used in any form without prior written permission from Parker Visual LLC. Portfolio images are shown solely to illustrate our services; unauthorized use of any image is a violation of federal copyright law and will be pursued accordingly.
7. Cookies and Analytics
The Parker Visual LLC website uses cookies to support website functionality and collect aggregate visitor analytics. Cookies used on this site do not contain personally identifiable information and are not used for advertising targeting or cross-site behavioral tracking. You may disable cookies through your browser settings at any time. We do not currently use advertising pixels, retargeting cookies, or behavioral advertising tools. 9. GDPR — EU Visitors
The Parker Visual LLC website and services are based in the United States and are intended primarily for US-based clients. If you are visiting from the European Union or European Economic Area, you may have rights under the General Data Protection Regulation (GDPR), including the right to access, correct, restrict, or delete your personal data, and the right to data portability. Parker Visual LLC does not sell or share personal information with third parties for their own marketing or commercial purposes. 11. Marketing Communications
Parker Visual LLC may send marketing emails to current and prospective clients, including seasonal promotions and new service announcements. All marketing emails include an unsubscribe mechanism. You may opt out at any time by clicking the unsubscribe link in any email or by contacting Hello@ParkerVisual.com. Opting out does not affect transactional communications directly related to your booking, session, or order.
12. DMCA — Copyright Claims
Parker Visual LLC is the copyright holder of all photographs produced under its services. Unauthorized reproduction or use of these images is a violation of federal copyright law.
To report content on our website that you believe infringes your copyright, submit a written notice to Hello@ParkerVisual.com that includes: your name and contact information; identification of the copyrighted work you claim has been infringed; the specific URL where the allegedly infringing content appears; a good-faith statement that the use is not authorized by the copyright owner; and a statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner. The Parker Visual LLC website and all content on it are provided on an “as is” and “as available” basis without warranties of any kind, express or implied. Parker Visual LLC makes no warranty that the website will be uninterrupted, error-free, or free of harmful components. Visiting this website does not create any professional, contractual, or fiduciary obligation on the part of Parker Visual LLC.
14. Governing Law
These Terms and Conditions are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any dispute arising from or related to these Terms and Conditions or use of this website shall be resolved in the courts of Suffolk County, Massachusetts. Disputes arising from photography services are governed by the Parker Visual LLC Client Services Agreement.
15. General Provisions
Severability. If any provision of these Terms and Conditions is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
Waiver. Parker Visual LLC’s failure to enforce any provision of these Terms and Conditions in a particular instance does not constitute a waiver of that provision or the right to enforce it in the future.
16. Changes to These Terms
Parker Visual LLC reserves the right to update these Terms and Conditions at any time. Updates will be reflected on this page with a revised date. Changes to these Terms and Conditions do not modify any Client Services Agreement already signed.
