1. Agreement to Terms

By visiting the Parker Visual LLC website, booking a session, submitting an inquiry, making a payment, or using any service offered by Parker Visual LLC, you agree to be bound by these Terms and Conditions in full. If you do not agree to these terms, do not use this website or proceed with booking.

These terms apply to all visitors to the Parker Visual LLC website and to all services offered by Parker Visual LLC, including portrait photography, professional headshot sessions, graduation portrait sessions, corporate headshot sessions, corporate event photography, in-home portrait sessions, and print and card orders.

2. Booking and Retainer

All session bookings require a non-refundable retainer (referred to as a “booking fee” in client communications) to confirm the date and time. No booking is considered confirmed until the retainer is received. The retainer is earned upon receipt as compensation for holding the reserved time slot.

The remaining session balance is due on or before the session date unless otherwise agreed in writing by Parker Visual LLC. Failure to pay the remaining balance by the session date may result in the session being cancelled and the retainer being forfeited.

Accepted payment methods include major credit cards, debit cards, and other methods communicated at the time of booking. Payments are processed securely through Square.

Clients may reschedule once using their retainer credit, subject to availability. A second reschedule request requires a new non-refundable retainer. The original retainer is not transferable to a third session date. If a rescheduled session is not confirmed to a new date within 90 days of the original session date, the retainer is forfeited and the booking is released.

Travel fees, where applicable, are disclosed prior to booking confirmation and are incorporated into the total session fee. Travel fees are non-refundable once a session date is confirmed.

For corporate event and full-day sessions, a separate written agreement may be required in addition to these terms. That agreement will take precedence over these terms where the two conflict.

3. Cancellation, Rescheduling, and Weather

Please refer to the Parker Visual LLC Refund Policy for complete details on cancellations, rescheduling, no-shows, weather postponements, and related matters. The Refund Policy is incorporated into these Terms and Conditions by reference.

4. Copyright Ownership

All photographs, images, and visual content produced by Parker Visual LLC during any session are the exclusive intellectual property of Parker Visual LLC and are protected under United States copyright law. Parker Visual LLC retains full copyright in all images, including both delivered and undelivered images from any session.

The purchase of a photography session does not constitute a transfer of copyright. Clients receive a license to use their images as described in Section 5 below.

Unedited or raw files are the sole property of Parker Visual LLC and are not included in any standard session package. Raw files may be made available only through a separate written agreement and are subject to additional fees. No request for raw files creates an obligation on Parker Visual LLC to provide them absent such a written agreement.

5. Client Image License

Upon full payment of the session fee, Parker Visual LLC grants the client a personal, non-exclusive, non-transferable, royalty-free license to use the delivered edited images for personal use (including printing, sharing with family and friends, and personal social media), professional use (including LinkedIn profiles, personal websites, email signatures, professional portfolios, and business cards), and internal business use (such as company websites and internal directories).

This license does not permit the resale or commercial licensing of images to third parties, use of images in paid advertising, stock photography, or commercial campaigns, transfer of images to third-party photographers or agencies for use as their own work, or modification of images in ways that significantly alter their original character — without prior written consent from Parker Visual LLC.

Clients booking headshot or corporate sessions acknowledge that the personal use license above covers standard professional use, including LinkedIn profiles, company profile pages, internal directories, and personal professional portfolios. Use of images in paid advertising, brand campaigns, product marketing, or any other commercial context requires a separate written commercial license agreement and additional fee. Clients intending commercial use must notify Parker Visual LLC prior to the session date so that appropriate licensing can be arranged.

6. Portfolio and Marketing Use

Parker Visual LLC reserves the right to display session images in our portfolio, website, social media channels, and marketing materials. This right exists unless the client submits a written opt-out request to Hello@ParkerVisual.com prior to the session date. Opt-out requests made after gallery delivery will be honored on a going-forward basis but cannot retroactively remove images already published.

For corporate clients, we will confirm portfolio usage rights in writing before publishing any images from on-site sessions or events.

7. Model Release

By booking a session and proceeding with photography, the client grants Parker Visual LLC permission to use the resulting images for portfolio, marketing, and promotional purposes as described in Section 6. This constitutes the client’s model release unless an opt-out is submitted as described above. For sessions involving minors, the parent or legal guardian signing these terms provides this release on the minor’s behalf.

8. Image Delivery

Edited images are delivered via an online gallery link within the timeframe communicated at booking. Standard delivery is 5 to 7 business days from the session date. Expedited 48-hour delivery is available for select packages as noted at the time of booking. Delivery timelines are good-faith estimates; delays caused by circumstances outside Parker Visual LLC’s reasonable control do not constitute a breach of these terms.

The number of final edited images is determined by the package booked. Parker Visual LLC selects which images from the session are delivered based on technical quality, composition, and professional judgment. If a proof selection process is used, clients must submit image selections within 14 days of proof delivery. If selections are not received within 14 days, Parker Visual LLC will select images on the client’s behalf at its sole discretion, and those selections will constitute final delivery.

One round of minor adjustment requests (crop, color tone, brightness) on delivered images is included at no additional charge, provided the request is submitted within 14 days of gallery delivery. Additional editing requests beyond the included round are billed at $20 per image.

Client galleries remain accessible for 90 days from the date of delivery. Clients are responsible for downloading their images before the gallery expires. Parker Visual LLC is not obligated to restore galleries that have expired.

9. Client Conduct and Cooperation

Clients are expected to arrive on time, prepared, and in the attire confirmed for the session. Parker Visual LLC is not responsible for outcomes affected by client lateness, unpreparedness, or failure to follow pre-session guidance provided in advance.

Parker Visual LLC reserves the right to end a session early if a client is abusive, disrespectful, or creates unsafe conditions, without refund. In such cases, the retainer and any fees paid are forfeited and Parker Visual LLC has no further obligation to the client. Clients are responsible for the behavior of any guests, children, or additional participants present during their session.

Parker Visual LLC exercises full creative discretion over all aspects of the session, including composition, lighting, posing guidance, image culling, and post-processing style. Parker Visual LLC cannot guarantee specific poses, expressions, moments, or outcomes. Results depend on cooperation of subjects, available light, location conditions, and other variables outside Parker Visual LLC’s control. Dissatisfaction with creative outcomes, absent a failure to deliver the agreed number of edited images, does not entitle a client to a refund.

For in-home sessions, clients are responsible for ensuring the space is accessible, reasonably prepared for photography, and has adequate natural light or open space. Parker Visual LLC is not responsible for photographic outcomes limited by the physical constraints of the location. Subjects added on the day of the session beyond the number reasonably implied by the session type may result in additional fees, which will be communicated before the session concludes.

10. Limitation of Liability

Parker Visual LLC’s total liability to any client for any claim arising from or related to a session or service shall not exceed the total amount paid by the client for that specific session. Parker Visual LLC is not liable for any indirect, incidental, consequential, or punitive damages, including loss of income, loss of anticipated business, or emotional distress.

In the event of equipment failure, data loss, or other unforeseen circumstances that result in the loss of session images, Parker Visual LLC’s sole obligation is to refund the session fee paid. Every reasonable precaution is taken to protect session images, including use of professional-grade equipment and redundant storage.

Indemnification. Client agrees to indemnify, defend, and hold harmless Parker Visual LLC and its owner from any and all claims, damages, losses, costs, and expenses (including reasonable attorney’s fees) arising from: (a) client’s use of delivered images outside the scope of the personal use license granted in these terms; (b) client’s breach of any provision of these Terms and Conditions; or (c) any third-party claim arising from client’s conduct in connection with Parker Visual LLC’s services.

11. Force Majeure

Parker Visual LLC is not liable for failure to perform or delay in performing any obligation under these terms where such failure or delay is caused by events beyond our reasonable control, including severe weather, natural disasters, public health emergencies, power outages, or government-imposed restrictions. In such cases, Parker Visual LLC will make reasonable efforts to reschedule the session at a mutually convenient time.

12. Print Orders

Print orders placed through the online gallery or directly with Parker Visual LLC are fulfilled by a third-party professional photo lab. By placing a print order, you acknowledge that the order is final once submitted for production and cannot be cancelled or refunded except in cases of production defect or damage. See the Refund Policy for details.

Parker Visual LLC does not guarantee color accuracy on print orders across different display devices. Clients are encouraged to consult with Parker Visual LLC before placing large or specialty print orders.

13. Website Use

Visitors to the Parker Visual LLC website may use it for personal, informational purposes only. By accessing this website, you agree not to use automated tools or scripts to scrape or extract content, attempt to access restricted areas or systems, transmit malware or disruptive code, use the website in any way that violates applicable law, or reproduce or redistribute any content from the website without prior written permission from Parker Visual LLC. Parker Visual LLC reserves the right to restrict or terminate access for any visitor who violates these terms.

14. Intellectual Property

All content on the Parker Visual LLC website — including photographs, portfolio images, text, page design, graphics, logos, and the Parker Visual LLC name and mark — is the exclusive intellectual property of Parker Visual LLC and is protected under United States copyright and trademark law. No content from this website may be copied, reproduced, downloaded, distributed, modified, or used in any form without prior written permission from Parker Visual LLC. Portfolio images are shown solely to illustrate our services; unauthorized use of any image is a violation of federal copyright law and will be pursued accordingly.

15. Cookies and Analytics

The Parker Visual LLC website uses cookies to support website functionality and collect aggregate visitor analytics. Cookies used on this site do not contain personally identifiable information and are not used for advertising targeting or cross-site behavioral tracking. You may disable cookies through your browser settings at any time. We do not currently use advertising pixels, retargeting cookies, or behavioral advertising tools. 16. Third-Party Links

Our website may contain links to third-party websites and platforms, including our Airbnb Experiences listing, our online gallery platform (Pixieset), our payment provider (Square), and our social media profiles. These links are provided for convenience only. Parker Visual LLC is not responsible for the content, accuracy, privacy practices, or terms of any third-party website. We encourage you to review the privacy policies and terms of any external sites you visit.

17. GDPR — EU Visitors

The Parker Visual LLC website and services are based in the United States and are intended primarily for US-based clients. If you are visiting from the European Union or European Economic Area, you may have rights under the General Data Protection Regulation (GDPR), including the right to access, correct, restrict, or delete your personal data, and the right to data portability. Our lawful basis for processing personal data is contract performance and legitimate interests. To exercise your GDPR rights or lodge a complaint, contact us at Hello@ParkerVisual.com.

18. CCPA — California Residents

If you are a California resident, you may have rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including the right to know what personal information we collect and how it is used, the right to request deletion or correction of your personal information, and the right to opt out of the sale or sharing of personal information. Parker Visual LLC does not sell or share personal information with third parties for their own marketing or commercial purposes. 19. Marketing Communications

Parker Visual LLC may send marketing emails to current and prospective clients, including seasonal promotions and new service announcements. All marketing emails include an unsubscribe mechanism. You may opt out at any time by clicking the unsubscribe link in any email or by contacting Hello@ParkerVisual.com. Opting out does not affect transactional communications directly related to your booking, session, or order.

20. DMCA — Copyright Claims

Parker Visual LLC is the copyright holder of all photographs produced under its services. Unauthorized reproduction or use of these images is a violation of federal copyright law.

To report content on our website that you believe infringes your copyright, submit a written notice to Hello@ParkerVisual.com that includes: your name and contact information; identification of the copyrighted work you claim has been infringed; the specific URL where the allegedly infringing content appears; a good-faith statement that the use is not authorized by the copyright owner; and a statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner. 21. Disclaimers

The Parker Visual LLC website and all content on it are provided on an “as is” and “as available” basis without warranties of any kind, express or implied. Parker Visual LLC makes no warranty that the website will be uninterrupted, error-free, or free of harmful components. Information on this website, including pricing and service descriptions, is subject to change without notice. Visiting this website does not create any professional, contractual, or fiduciary obligation on the part of Parker Visual LLC.

22. Artificial Intelligence

AI-Assisted Editing. Parker Visual LLC uses AI-assisted tools as part of its standard editing and retouching workflow, including for tasks such as background cleanup and image enhancement. All creative decisions remain the professional judgment of Parker Visual LLC. Parker Visual LLC does not use AI to alter or generate the subjects depicted in any image or to produce synthetic portraits. All subjects in delivered images are real people photographed during the confirmed session.

No AI Training Use of Client Images. Parker Visual LLC does not use client images, session photographs, or the likenesses of any subjects to train, develop, fine-tune, or improve any artificial intelligence system, machine learning model, or automated image recognition or generation tool. Client images are used solely to fulfill the services described in these terms. Where editing, storage, or gallery platforms offer opt-outs from AI or machine learning training programs, Parker Visual LLC configures those settings to exclude client content to the extent permitted by the platform.

Prohibition on Client AI Training Use. The personal use license granted to clients under Section 5 does not include the right to use delivered images — or the likenesses of any subjects depicted in those images — for the purpose of training, developing, fine-tuning, testing, or improving any artificial intelligence system, machine learning model, or automated image recognition or generation tool. This prohibition applies to clients, their agents, and any third party to whom clients provide access to the images.

23. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.

Any dispute arising from or related to these terms or Parker Visual LLC’s services shall first be addressed through good-faith communication between the parties. Clients are encouraged to contact Hello@ParkerVisual.com before escalating any dispute. If a dispute cannot be resolved informally, both parties agree to attempt good-faith mediation before initiating any legal proceedings, with mediation costs shared equally unless otherwise agreed. If mediation is unsuccessful, disputes shall be resolved in the courts of Suffolk County, Massachusetts.

24. General Provisions

Severability. If any provision of these Terms and Conditions is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Waiver. Parker Visual LLC’s failure to enforce any provision of these Terms and Conditions in a particular instance does not constitute a waiver of that provision or the right to enforce it in the future.

Electronic Signatures. Electronic signatures, whether submitted through a digital signing platform, email confirmation, or other electronic means, are legally valid and binding to the same extent as handwritten signatures.

Assignment. Clients may not assign or transfer their rights or obligations under these terms without the prior written consent of Parker Visual LLC.

25. Entire Agreement

These Terms and Conditions, together with the Refund Policy and any written booking confirmation or separate corporate agreement, constitute the entire agreement between the client and Parker Visual LLC regarding the services described herein and supersede any prior discussions or representations.

26. Changes to These Terms

Parker Visual LLC reserves the right to update these Terms and Conditions at any time. Updates will be reflected on this page with a revised date. Bookings made prior to an update are governed by the terms in effect at the time of booking.
